the brands above, collectively “The Business”).

1. Membership Overview
• These Terms govern all memberships, programs, classes and coaching services offered
by The Business.
• Memberships are billed on a recurring direct-debit basis through Mindbody using Stripe
as the integrated payment processor.
• Each membership has a minimum term, calculated as the weekly fee × the number of
weeks.
• After the minimum term, memberships automatically continue week-to-week until
cancelled in accordance with Clause 6.
2. Direct Debit Authority
By signing this agreement, you authorise debit payments from your nominated account via
Stripe/Mindbody for fees and charges under this contract.
All debits are processed in advance and continue beyond the initial term unless cancelled
under Clause 6.
3. Fees & Payments
• Bank-account transaction fee: $1.25
• Card surcharge (Visa/Mastercard and Amex/Diners if accepted): 2.2 % (min $1.25) or
the actual cost of acceptance, whichever is lower.
• Dishonour/failed-payment fee (set by Stripe or Mindbody): up to $15.
• You must maintain valid payment details and sufficient funds. Unpaid balances may
result in suspension until settled.
4. Updating Account Details
Payment details may be updated at any time by contacting administration. If a transaction fails,
The Business may recover outstanding balances using any previously authorised account
details.
5. Overdue Accounts & Recovery
If amounts remain unpaid after reasonable notice, The Business may refer the account to a
collection agency. You agree to pay any reasonable recovery costs actually incurred (as per
ACL requirements). Once referred, payments must be arranged through the agency.
6. Cancellation & Cooling-Off
• Cancellation requests must be submitted via email to [email protected].
• A 30-day notice period applies after the initial term.
• Cancellations cannot be processed while a membership is suspended.
• Memberships roll week-to-week unless written notice is received.
• Members cannot downgrade during the 30-day cancellation period.
Cooling-Off Period: You may withdraw within 48 hours of signing by emailing the address
above. Payments already processed before your notice are non-refundable except as required
under the Australian Consumer Law.
7. Suspension Policy
• Suspension requests must be made at least 7 days in advance.
• Maximum suspension: 4 weeks per calendar year, in full-week blocks.
• Extensions for medical or travel reasons may be approved on reasonable evidence.
• No suspension fee applies.
8. Missed Sessions / No-Shows
• Cancel bookings ≥ 2 hours before start time via the Mindbody app to avoid a fee (default
$5).
• Make-up sessions must be used within 2 weeks while your membership is active and
not suspended.
9. Personal Training & Coaching
• Cancellations or reschedules within 24 hours of the appointment are charged in full.
• ≥ 24 hours’ notice allows reschedule at no extra cost (subject to availability).
10. Transformation & Coaching Programs
For programs with limited intakes or up-front content delivery, early termination requests for
special circumstances (e.g. medical) will be assessed reasonably. Any payable amount will
reflect services and materials already provided, minus reasonable savings to The Business.
11. Upgrades & Downgrades
• Upgrades take effect immediately.
• Downgrades are available only after the minimum term or by extending the duration to
preserve the original contract value.
• Processing may take up to 14 days.
12. Health & Safety / Heat Room Notice
• You confirm you are medically fit to exercise and will disclose any injury, condition or
pregnancy.
• Exercise involves inherent risk. Follow coach instructions and use equipment properly.
• Hot/infrared classes carry extra risk (dehydration, dizziness). Hydrate and exit if unwell.
• The Business is not liable for injuries arising from your misuse or failure to follow
instructions except where liability cannot be excluded under law.
13. Minors & Youth Participation
Participants aged 13 to 17 years may join classes or programs only with parent or guardian
consent. A liability waiver and participation release form must be electronically signed by the
parent or guardian prior to participation.
Where required, minors must be accompanied and supervised by a parent or guardian during
sessions or while on the premises. The Business reserves the right to refuse participation if
consent documentation has not been completed or if supervision requirements are not met.
14. Children in Facilities
Children are welcome in designated areas only and must remain under the direct supervision of
a parent or guardian at all times.
Parents or guardians are fully responsible for the safety, behaviour, and actions of their children
while on the premises, including any injury, damage, or disruption caused.
The Business accepts no liability for any injury, loss, or incident involving unsupervised children.
A supervised children’s area is available during the following times:
• Training: Monday to Friday 9:30 AM – 10:30 AM / Saturday 9am-10am
Outside these designated times, children are not permitted in training or class areas for safety
reasons.
15. Facility Conduct
• Bring a towel and wear enclosed shoes.
• Return equipment and maintain tidy spaces.
• Zero-tolerance for harassment, violence, drug use or unsafe behaviour — membership
may be terminated immediately.
• Members are liable for damage they cause through wilful or negligent acts.
16. Timetables & Closures
• Class schedules and coaches may change.
• Public holidays may operate on reduced timetables.
• Temporary closures for maintenance or events may occur. If a closure exceeds 7
consecutive days without reasonable alternatives, The Business will credit or extend
your membership for the affected period.
17. Events & Competitions
Special events may carry additional terms or waivers. Where inconsistent, the special terms
govern that event.
18. Online Programs & Digital Content
Digital content (nutrition guides, videos, online programs) is for personal use only and must not
be shared or resold.
Remote exercise is at your own risk; ensure a safe environment and equipment.
19. Photography & Media
Photos or videos may be taken during classes or events. By participating, you consent to their
reasonable use for promotion unless you opt out in writing beforehand. The Business will
honour privacy requests.
20. Privacy & Marketing
The Business complies with the Privacy Act 1988 (Cth) and Australian Privacy Principles.
Personal data is used only for service delivery and communication. We do not sell data.
You may opt out of marketing emails or texts at any time.

21. Intellectual Property
All programs, materials, videos and brand assets belong to The Business. You receive a
personal, non-transferable licence for your own training use only.

23. Consumer Guarantees & Liability
Nothing in these Terms excludes non-excludable rights under the Australian Consumer Law.
Where permitted, our liability is limited to re-supplying the service or paying the cost of re-
supply.
24. Price Changes & Policy Updates
We may update fees or terms with 14 days’ notice for material changes. You may cancel (with
standard notice) before changes take effect.
25. Force Majeure
We are not liable for delays or failures caused by events beyond our control (e.g. government
orders, pandemics, weather, utility failure). We will act reasonably to provide alternatives or
extensions.
26. Personal Belongings & Parking
Personal property and vehicles are left at your own risk. Lost property is held for a reasonable
period then disposed of.
27. Transfer & Access
Memberships are non-transferable without written approval. Access sharing is prohibited. We
may refuse entry or cancel access for breach of these Terms or directions of staff.
